Pod pozorem ochrony życia płodu Trybunał Konstytucyjny znacznie ograniczył prawa reprodukcyjne kobiet. Ograniczenie dotyczy możliwości podjęcia autonomicznej decyzji w przypadku ciężkiego i nieodwracalnego upośledzenia lub nieuleczalnej choroby płodu. Glosa analizuje błędy Trybunału w wyważaniu wartości konstytucyjnie chronionych. Autorki wskazują również, że Trybunał wkroczył niezasadnie w obszar spraw, które powinien rozstrzygnąć parlament.

Under the guise of protecting the life of the foetus, the Constitutional Tribunal significantly restricted the reproductive rights of women. The restriction applies to the possibility of making an autonomous decision in the event of a severe and irreversible impairment or an incurable illness of the foetus. The commentary analyses errors of the Tribunal in balancing the constitutionally protected values. It also explores the jurisdiction of the Tribunal on matters which should be decided by the parliament.
