Państwo i Prawo 2023, nr 12, s. 64-84.

Recently, the impact of online platforms on human rights has been widely analysed. Nowadays, online platforms play an essential role in shaping the public sphere and determining the conditions for exercising individual rights and freedoms. The power gained by platforms was enabled, among others, by regulating the principles of their operation by means of private law, which did not initially provide adequate protection for platform users. Various legislative centres are trying to find a remedy for this situation, using instruments derived from public law. The article analyses the possibility of applying constitutional provisions to the activities of online platforms. It also describes how mechanisms derived from public law can be used to regulate the functioning of online platforms.
