Security First : The New Right-Wing Government in Poland and its Policy towards Immigrants and Refugees

The so called refugee crisis in 2015 coincided with the Polish parliamentary electoral campaign. The effect of it was – for the first time in Poland – the introduction of migration policy to the political agenda of the right-wing and populist political parties on a massive scale. They presented migration as an issue of security – both national and cultural, direct and symbolic. The new government, acting since the end of 2015, included immigration and asylum issues into their political programme as a key element of national security. Their discourse about refugees is usually based on the differentiation: us and them. And “them” are pictured as evil, dangerous, Muslim terrorists.
The new government and its authoritarian style of governing has introduced a number of initiatives designed to deprive individuals of immigrant rights (like in the new so-called Antiterrorist Act from the mid of 2016, based on which every foreign citizen could be put under surveillance without any court control) or to stop refugee influx on the Polish territory in any way – directly from their country of origin (new amendments to asylum law are trying to introduce border and accelerated procedures) or under the UE resettlement and relocation programme (Poland is one of 3 EU Member States – along Hungary and Austria – that hasn’t relocated anyone).
In this paper I will present in more detail the legal changes described above, their consequences and the so-called rationalities presented by the government.

Families as a Collective Abuser : a Case of Family Violence against Chechen Refugee Women in Poland

Family is usually perceived as a source of support. It includes the closest relatives that we turn to for help when in dire straits. In the case of migration, the family also constitutes an anchor of sorts that you can hold on to when the need arises. It is not always, though, that the family plays a positive role. When its role is extended to affect all the aspects of life, it can be seen as an oppressor. In my article I present different forms of the family’s influence on a woman’s choices among Chechen refugees in Poland. I focus on forced marriages and ‘honour’ killings. This article is based on fifteen individual in-depth, partly structured, biographical interviews with female refugee and asylum seekers women from Chechnya who had experienced violence at the hands of a close person. It is supplemented with 27 individual and 4 group semi-structured in-depth interviews with 35 experts, who work with refugees or women with the history of experienced violence. The results show that in case of Chechen refugees in Poland, the family not only fails to provide protection but also its members are perpetrators of violence against their nearest and dearest. It is because of family’s close ties which affect Chechen women in particular but also because of the weakness of the Polish welfare system. Without constant economic assistance from the members of the family (left in Chechnya or residing in another EU country) it is nearly impossible to support a large family in Poland.

Closing Gates to Refugees : The Causes and Effects of the 2015 “Migration Crisis” on Border Management in Hungary and Poland

In this paper, I demonstrate the process of treating asylum seekers and refugees as a dangerous enemy. Those two groups of immigrants find themselves at the receiving end of measures that infringe basic humanitarian laws and human rights, and are so inhumane that no one would ever dare to introduce them on their own citizens. Equating refugees with terrorists and prioritizing security constitute two pillars of the ruling parties’ policy in Poland and Hungary. Apart from technical security measures (like fences), both governments adopt additional instruments to discourage migrants from coming or encourage them to leave (like creating obstacles to let them onto the territory of the country, refusing to grant them international protection, making their integration difficult or almost impossible). Such activity fulfils the definition of “Fortress Europe”, which is not only about building stone walls or fences but about increasing control of every aspect of migrants’ lives as well.

Nasze opracowanie składa się z czterech części. W pierwszej z nich Witold Klaus omawia regulacje prawne określające ramy nadawania w Polsce cudzoziemcom ochrony międzynarodowej i krajowej oraz najważniejsze zmiany w prawie, jakie zostały wprowadzone w tym zakresie od momentu, kiedy Polska przystąpiła do Konwencji Genewskiej. Przedstawia on także prawne uwarunkowania integracji cudzoziemców objętych w Polsce ochroną. W drugiej części Agata Górny podejmuje próbę syntetycznego opisu tendencji na przestrzeni 25 lat (tj., kiedy Polska nadaje status uchodźcy), jeżeli chodzi o skalę napływu i kraje pochodzenia osób wnioskujących o status uchodźcy i cudzoziemców otrzymujących w Polsce inne formy ochrony. Część ta ukazuje także osoby objęte ochroną krajową lub międzynarodową w Polsce na tle innych cudzoziemców mieszkających w naszym kraju. Kolejna część autorstwa Haliny Grzymały-Moszczyńskiej dotyczy integracji cudzoziemców objętych ochroną w Polsce. Na podstawie dostępnych badań omawia ona najważniejsze osiągnięcia i wyzwania w tym zakresie w Polsce, wydzielając dwa istotne okresy w życiu cudzoziemców starających się w Polsce o status uchodźcy: okres oczekiwania na decyzję legalizacyjną i czas po jej otrzymaniu. Czwarta część opracowania ma odmienny charakter. Sławomir Łodziński koncentruje się bowiem na przemianach postaw polskiego społeczeństwa wobec cudzoziemców i uchodźców, a nie na realnych procesach ich napływu i integracji w Polsce. Ukazuje je on w sposób wielowymiarowy, biorąc pod uwagę różne grupy imigrantów i uchodźców, różne dyskursy w Polsce oraz zestawiając sytuację w Polsce z sytuacją w innych krajach Europy Środkowej. Opracowanie zamykają ogólne obserwacje oraz rekomendacje odnoszące się do napływu i integracji cudzoziemców objętych ochroną krajową i międzynarodową w Polsce.
