Tradycje francuskiego konstytucjonalizmu w polskiej myśli ustrojowej

The influence of French constitutionalism on the Polish legal order is still present in the studies and analyses of the doctrine of constitutional law. Indeed, the French constitutional tradition forms part of the European legal heritage to which the founders of Polish statehood readily referred. The present text outlines the main thoughts and ideas which, over a period of more than two hundred years – from the second half of the 18th century to the present day – have influenced the constitutional shape of the Polish state either by way of recapitulating or negating various institutional solutions.

Oddziaływanie francuskiego konstytucjonalizmu na polski porządek prawny jest obecne w badaniach i analizach doktryny prawa konstytucyjnego. Francuska tradycja konstytucyjna tworzy bowiem część dziedzictwa prawnego Europy, do którego twórcy polskiej państwowości chętnie się odwoływali. Niniejszy tekst przedstawia główne myśli, które na przestrzeni ponad dwustu lat – od drugiej połowy XVIII w. do czasów nam współczesnych – wpływały na kształt ustrojowy państwa polskiego w drodze recypowania, negowania albo przejmowania w zmienionym kształcie rozmaitych rozwiązań instytucjonalnych.

The author discusses the challenge to the parliamentary majority enjoyed by the “Law and Justice” party (PiS) in Poland and the cohabitation established by the legislative elections of 15 October 2023. This article aims to analyse, given the high rate of electoral participation, the elements which undermined the power of this party, in particular the dialogue between national and European jurisdictions, the confrontation with the European institutions and the attacks on the Rule of law.

Poland’s accession to the European Union 20 years ago was a real accelerator in the process of democratization of the country and the development of its economy. After the 2015 parliamentary elections, a fundamental change in the perception of the State and the law and their relations with the European Union occurred. A crisis that has gone through several phases, analyzed in this study, which end is expected since the Tusk government came to power in order to allow the Polish State to continue the economic transformation, with a return to the values of the Union desired by citizens.
