Rozwiązanie Zgromadzenia Narodowego we Francji w 2024 r. : naprawa systemu czy umocnienie kryzysu instytucjonalnego
Przegląd Sejmowy 2026, nr 1 (192), s. 9–32.
Sejm RP i Senat RP mają w polskim porządku prawnym określone funkcje i uprawnienia. Znajduje ona wyraz w wielu działaniach posłów i senatorów, w tym w upamiętnianiu ważnych w dziejach narodu i państwa polskiego postaci, organizacji, instytucji, idei, wydarzeń, miejsc i miast w corocznych uchwałach ustanawiających patrona danego roku.
The shortening of parliamentary terms is known in parliamentary systems, where it serves as a means of managing conflicts between the legislature and the executive, and – in a broader sense – supporting the institutional stability of the state. It has a long tradition in France. President Emmanuel Macron’s decision in June 2024 came as a surprise, has raised a number of political and institutional questions, and will certainly be the subject of critical analyses for a long time to come. Although it is difficult to predict the long-term effects of the said decision, it has been clear from the start that it caused institutional confusion and social disappointment. Moreover, the consequences of the decision may be even more serious for the state than those resulting from the previous difficulties in the relations between parliament and government. The new experience is thought-provoking and allows us to look at the mechanism in question from a different perspective.
Parliamentary Mandate and Membership of the Council of Ministers : reflections on Potential reforms in Polish Law and Constitutional Practice
Krytyka Prawa. Niezależne studia nad prawem 2026, t. 18, nr 2, s. 8–22.
The principle of incompatibility is highly significant for upholding the standards of a democratic state governed by the rule of law. It helps shape the structure of the system of public authorities and constitutes one of the fundamental guarantees of the independent exercise of the parliamentary mandate. The 1997 Polish Constitution provides an extensive catalogue of functions that may not be combined with a parliamentary mandate. At the same time, it expressis verbis provides for an exception for members of the Council of Ministers and secretaries of state in government administration. This article argues that while this solution is characteristic of parliamentary-cabinet systems of government, it also gives rise to certain adverse phenomena. In Poland, there is a persistent tendency to appoint parliamentarians to numerous ministerial and secretary-of-state positions, a practice that is subject to critical assessment by legal scholars and commentators as well as in public discourse. Under the current legal framework, the arguments for maintaining the constitutional exception to the principle of incompatibility are intertwined with arguments calling for its abolition.
