Oblicza i aporie rozliczalności władzy sędziowskiej

Artykuł dotyczy dokonuje próby odseparowania rozliczalności sędziowskiej od form odpowiedzialności sędziów. Prezentuje propozycję terminologiczną rozliczalności sędziowskiej w nauce prawa, przedstawia podstawowe założenia realizacji rozliczania władzy sędziowskiej wobec form odpowiedzialności, proponując rozdzielenie tych kategorii oraz zakres przedmiotowy i podmiotowy rozliczalności. Rezultatem analizy są wnioski do-tyczące form rozliczalności poprzez uzasadnienie decyzji sędziowskich oraz zarysowa-nie zagrożeń, jakie dotyczą tej kategorii.

The article regards the problem how to separate judicial accountability from the other forms odf judges liability. It presents a proposal of judicial accountability concept in le-gal science, the basic assumptions for the settlement of judicial power towards forms of responsibility, proposing the separation of these categories. and the subject and object scope of judicial accountability. The result of the analysis are conclusions on the forms of accountability within judicial power, especially judges’ decisions – and outlining some threats that apply to them.

The text presents some features of the contemporary art market and a few specific issues related to the valuation and circulation of works of art. The specificity of the art market, the role of experts and intermediaries, difficulties in valuing works of modern art, have an impact on the scope and content of the protection of moral and material interests resulting from artistic production, the scope and content of freedom of artistic creativity. Processes of valuing artworks bring questions on the necessity of the introduction of regulatory mechanisms to increase the transparency of transactions, in order to protect the value of works of art and the freedom of artistic creativity.

Artykuł prezentuje kilka cech współczesnego rynku sztuki związanych z ewaluacją i obrotem dziełami sztuk pięknych. Specyfika rynku sztuki, zwłaszcza rola ekspertów i pośredników w obrocie, w świetle trudności w miarodajnej ocenie wartości dzieł sztuki współczesnej mają wpływ na zakres i treść ochrony interesów osobistych i majątkowych twórców, a w konsekwencji – zakres i treść wolności twórczości artystycznej. Procesy wyceny dzieł sztuki uzasadniają tezę o konieczności wprowadzenia mechanzmów regulacyjnych w celu zwiększenia transparentności transakcji w celu ochrony wartości dzieł sztuki i wolności twórców, jak też zagwarantowania pozostałym uprawnionym dostępu do efektów pracy artystycznej.

Accountability as a Category of Constitutional Law : Terminological Considerations

This text presents the category of accountability, which is well known in the social sciences, in the context of constitutional law institutions as a useful tool for reflecting on the development of the taking/giving of an account by reporting to the entity that entrusted the constitutional law institutions with their function. The article argues that accountability can be a pivotal category in at least three dimensions: 1) for the implementation of the principle of the democratic entrustment of power within the obtained mandate; 2) the division of powers and the system of mutual entrustment and settlement of their performance, as well as 3) accounting for competencies entrusted to public administration. The text presents the features of accountability in the system of the division of powers, with the indication of key problems in this area, and briefly presents the institutions of constitutional law that can be treated as serving the implementation of accountability.
