Zajmuje się naukowo prawem konstytucyjnym od 1999 roku. Przez wiele lat związana była z Wydziałem Prawa I Administracji Uniwersytetu Łódzkiego, później z Instytutem Nauk Prawnych PAN. Jest kierownikiem Zakładu Prawa Konstytucyjnego I Badań Europejskich od 2016 r. Od 2018 r. pełni funkcję kierownika Studiów Doktoranckich INP PAN.

Komisje śledcze w Polsce międzywojennej

Komisje śledcze stanowią istotny element kontroli sprawowanej nad władzą wykonawczą przez parlamentarzystów. W Polsce ta instytucja ma także długą tradycję, choć kształtowaną na przestrzeni stulecia dwukrotnie od początku, w zupełnie innych warunkach ustrojowych. Nasz artykuł ma za zadanie zaprezentowanie regulacji oraz działania takich komisji w okresie przed i po uchwaleniu Konstytucji z 1921 r. Przyjrzenie się regulacjom i praktyce z okresu dwudziestolecia pozwoli na lepsze zrozumienie uregulowania i funkcjonowania komisji śledczych przewidzianych w art. 111 Konstytucji z 1997 r., powstałej – jak deklaruje jej preambuła „w nawiązaniu do najlepszych tradycji Pierwszej i Drugiej Rzeczypospolitej”.

Committees of inquiry are an important element of parliamentary oversight of the executive. In Poland, this institution also has a long tradition, although it was shaped twice over the course of a century from the beginning, under completely different system conditions. Our article aims to present the regulations and activities of such committees in the period – before and after the adoption of the 1921 Constitution. A closer look at the regulations and practice from the twenty-year period will allow for a better understanding of the regulation and functioning of the committees of inquiry provided for in Art. 111 of the Constitution of 1997, created – as its preamble declares – “in reference to the best traditions of the First and Second Polish Republic”.

This article comments on the Polish Constitutional Tribunal judgment delivered on 22 October 2020 on the unconstitutionality of the provision of the Act of 1993 allowing for the termination of pregnancy for embryo-pathological reasons. The author provides a commentary on the judgment from the point of view of its formal features and content and demonstrates that it violates in both respects the right to privacy and freedom from inhuman or degrading treatment, as it was passed without taking into account nor properly balancing the rights of a pregnant mother in a situation of particular vulnerability.
