The article offers analysis of the legal framework of the institute of conditional release in Lithuania and Poland. In both countries, conditional release is considered a probationary measure to regulate prison overcrowding and promote effective social readaptation of convicts. The authors explore the concept of the conditional release at the international and national levels, reveal the content of the formal and substantive grounds of conditional release, and examine the similarities and differences in legal regulation of conditional release in Lithuania and Poland. In addition, the conditional release application statistics in Lithuania and Poland are compared. The authors argue that, despite their high prison population rates, Lithuania and Poland are reluctant to use some of the probation instruments, allowing for an early release of detainees, such as the conditional release. Moreover, the policies of Poland and Lithuania regarding this institute’s legislative regulation and criminal application seem insufficiently in line with international standards.

Implementation of the PIF Directive into Polish Criminal Law : Selected Issues
Studia Iuridica Lublinensia 2024, t. 33, nr 5, s. 223-236.
The article refers to Polish law and Directive (EU) 2017/1371 of the European Parliament and of the Council of 5 July 2017 on the fight against fraud to the Union’s financial interests by means of criminal law. The aim is to analyse selected Polish provisions currently in force in light of this Directive. Against the background of the EU legal instrument, the author points out the selected most significant loopholes in Polish law hindering an effective fight against crime detrimental to the financial interests of the Union. The analysis carried out in the article indicates, among others, that there is a high need to modify the Polish legal framework as regards the liability of collective entities for offences, as well as provisions on fraud.

Compliance in the Public Sector in the Light of the Guidelines of the Central Anti-Corruption Bureau as a Means to Overcome Impossibility in Preventing Corruption
Krytyka Prawa. Niezależne studia nad prawem 2020, t. 13, nr 2, s. 18-28.
The paper analyses the Guidelines issued in 2020 by the Central Anti-Corruption Bureau in Poland on the establishment and implementation of effective compliance programmes in the public sector. These guidelines constitute the very first Polish official document referring to compliance in the public sector. Its detailed critical analysis is therefore useful for the construction of compliance policies by public institutions, in order to prevent and possibly detect irregularities, including corruption, within these organisations.
Artykuł poświęcony jest analizie wydanych w 2020 r. Wytycznych CBA w Zakresie Tworzenia i Wdrażania Efektywnych Programów Zgodności (Compliance) w Sektorze Publicznym.

O potrzebie rzeczywistej kryminalizacji korupcji w sektorze prywatnym
On the need to really criminalize corruption in the private sector The article refers to the criminalization of corruptive behaviours in the private sector. It contains a thesis that Art. 296a of the Penal Code does not fulfil the requirements set forth in the international and EU law, as it constitutes an offence of economic corruption, covering corruptive behaviours undertaken both in the private and the public sectors. The aim of the article is to critically analyse the current wording of Art. 296a PC in the light of the international and EU law, as well as to formulate a de lege ferenda proposition of a new wording of this provision, which would finally penalize all corruptive behaviours in the private sector and at the same time put the Polish law in compliance with the international standards.

Studia Prawnicze 2014, nr 3, s. 5-27.
The notion and theories on legal transplants and – more broadly – legal transplantation have been an object of interest in comparative law in the world since the 70s., especially in the framework of research on mixed legal systems. The theories of legal transplants remain rather unknown to the Polish researchers. And yet they may constitute a useful tool of analysis of contemporary transformations of legal systems, stemming from globalization. The article is aimed at acquainting Polish readers with theories on mixed legal systems and legal transplants and explaining briefly in what way legal transplants contribute to the hybridization of legal systems in the world.

Judicial Control of the Prosecutors’ Activities in the Light of the ECHR
eucrim. The European Criminal Law Association' Forum 2014, nr 2, s. 60-63.
This article is a revised English version of a paper presented by the author at the conference “Le contrôle judiciaire du Parquet européen. Nécessité, modèles, enjeux,” which took place in Paris on 9–10 April 2014.
The judicial control of the activities of prosecutors within criminal proceedings constitutes an important issue in every legal system. It is particularly important at the pre-trail stage of proceedings, when the prosecutor is responsible for many actions, and of lesser importance at the judicial stage of the proceedings, when the court takes over. However, the issue of judicial control of prosecutors’ actions may warrant special attention once the European Public Prosecutor’s Office (hereinafter the “EPPO”) is established. When it comes to prosecutorial actions, the EPPO will be subjected to the control of the national courts. Therefore, it will be necessary to define the framework of the judicial control of the EPPO’s activities executed by national courts.
It seems obvious that in every legal system, with its specificities and traditions, the legal framework regarding the judicial control of prosecutors’ actions within criminal proceedings may vary. For this reason, it becomes necessary to search for a common ground, rules that might be useful and applicable in every legal system. In Europe, it may be enlightening to examine the standards related to the judicial control of prosecutorial activities set forth by the European Court of Human Rights. It will be particularly informative to find answers to the following three questions that will be considered in this article – who controls prosecutors, what is controlled, and what should be the control.

The internationalization of the Polish criminal law : how the Polish criminal law changed under the influence of globalization
Crime Law and Social Change 2013, t. 59, nr 2, s. 139-156.
Globalization changed the Polish criminal law. During the last 15 years the Polish criminal law has been transformed under the influence of globalization. The purpose of this study is to assess the extent and character of this process. The change was mainly a result of the implementation of legal instruments adopted by international organizations, to which Poland already belonged or aspired (European Union, Council of Europe, OECD, UN). This is what we can call the internationalisation of the Polish criminal law. Modifications affected many areas, in particular criminalisation. Definitions of certain existing offences were extended to cover interests which were not protected before (i.e. corruption offences). Also, new definitions were introduced (i.e. act of terrorist character). Additionally, other elements were changed. However, the impact of globalization on Polish criminal law goes beyond internationalisation. Certain criminalisations were introduced under the influence of foreign laws as a tool of fight against new types of crime, characteristic for the era of unification of cultural and social behaviours (e.g. stalking).

The article focuses on a new legal discipline called ‘transnational criminal law’. In Polish literature it has been discussed how to name the complex legal discipline referring to substantive and procedural issues related to offences with foreign component or to offences directly defined in international law. Different terms were put forward. The article argues that a new discipline has evolved, which discipline may be called ‘transnational criminal law’. It is different from both international and national criminal law, as far as its subject and manner of regulation are concerned. It encompasses conventional provisions obliging the states to criminalize certain behaviours. Since it is argued that the notion ‘transnational criminal law’ should now be used, corrected definitions of notions ‘international criminal law’ and ‘criminal law international’ are formulated.
Publicyzacja sfery prywatnej na przykładzie penalizacji korupcji w obrocie gospodarczym
Krytyka prawa : niezależne studia nad prawem 2012, t. 4, s. 219-237.
Proces ten wiązał się z umiędzynarodowieniem polskiego prawa karnego i zaowocował wprowadzeniem do kodeksu karnego nowego typu przestępstwa korupcji gospodarczej (art. 296a k.k.).

The Europeanisation of Polish Substantive Criminal Law : How the European Instruments Influenced Criminalisation in Polish Law
New Journal of European Criminal Law 2012, t. 3, s. 363-380.
Polish accession to the European Union has contributed to an extensive change of the Polish legislation, including substantive criminal law. The implementation of EU legal instruments led in particular to a change of definitions of crimes – new crimes were introduced and also already existing definitions were changed. The article aims at presenting the process of implementation of EU instruments taking as an example provisions on corruption and human trafficking. It argues that this process, which was one of the most powerful factors contributing to the change of the scope of criminalisation in the Polish criminal law over the last 15 years, lacked reflection on the ultima ratio principle and was full of mistakes made by the Polish legislator. As a result, a complete and real harmonisation of the Polish provisions with the EU criminalisation standards has not been fully achieved.

Inequality of Imprisonment in Europe : the Polish Perspective
Krytyka prawa : niezależne studia nad prawem 2011, t. 3, s. 229-240.
This article deals with the execution of the penalty of deprivation of liberty. I assert that different criminal policies applied in European countries make the prison population grow and lead to the overcrowding of prisons.

The authors of this article touch upon the criminal law aspects of incest and the criminalisation of such practices on the basis of the Polish Penal Code (Daniluk) and the solutions adopted in the following countries: Canada, Australia, the USA, and France (Nowak), while the views that they present are not fully consistent with each other. The first part of the paper outlines the norms of Polish law that regulate the issue of incest. According to Daniluk, the criminalisation of this practice is strongly connected with the protection of moral norms. The definitions of kinship and adoption are also discussed, as well as the issue of incest being understood as a victimless crime. The text touches upon the problems of disclosing and prosecuting such crimes with regard to the voluntariness of the act, as well as of identifying the forbidden act due to the imprecision of Article 201 of the Penal Code. Daniluk also argues that the law adopted in this area does not ensure sexual freedom, but rather limits it and serves only to protect morals. In the author’s opinion, there is doubt whether criminal law can regulate the issues of morality and sexual freedom. The arguments of researchers in the field of genetics are also quoted, showing the consequences for the health of any offspring from incestuous unions, although concerns of eugenics have been ignored by the legislature in the current regulations. The study concludes that the criminalisation of incest serves to protect proper family relations, indirectly taking into account eugenics, but does not constitute the protection of minors. In the second part of the article, Nowak describes the legal status referring to the issue of incest and its criminalisation in the above-mentioned countries. The article also focusses on the definition of incest and the scope of the relationships and persons subject to possible punishment. The author presents justifications for the criminalisation of incest in particular countries on the grounds of eugenics and protecting minors or morality. The author cites the work of committees for decriminalising incest which operate in Canada, Australia, and the USA, stressing that the drafts were rejected in all these countries. In this section, Nowak also discusses the issue of the value of individual freedom colliding with the protection of other values. The author asks to what extent criminal law tools can be used to regulate the sphere of sexual life. In the conclusions, Nowak addresses the problem of legitimacy in raising the argument of eugenics, if it is not applied to other groups and types of relationships where offspring may be burdened with genetic defects. She also raises the issue of to what extent criminal law should regulate family relations and how the public good is protected if the relationships are voluntary between two adults. The author points to the need for changes in the Polish legal system to protect minors in regards to incest as well as a reconsideration of changing the existing criminal law in favour of abandoning the regulation of the sexual freedom of adults.
