„Prawo do mieszkania” w orzecznictwie Sądu Najwyższego

The term ‘the right to housing’ has not been defined in any act of law, even though it is frequently used, even in legal discourse. This article attempts to reconstruct it in the light of the case law of the Supreme Court. It arises from the case law that this ‘right’, the constitutional source of which is Article 75 of the Polish Constitution, consists of the pursuit of a housing policy that supports the improvement of housing conditions, the treatment of the satisfaction of housing needs as a constitutional value, the combating of homelessness and the protection of tenants’ rights. Its application can involve the expansion of the argumentative layer of judgments by referring to Article 75 of the Polish Constitution, co-applying this provision with the statutory regulations and recognizing the values embedded in its general statutory clauses and vague definitions. Therefore, the ‘right to housing’ has normative potential that should be applied by the courts.

Organy upoważnione do wydawania rozporządzeń : teoria i praktyka

The 1997 Constitution of the Republic of Poland established a closed catalogue of authorities vested with the power to issue regulations. These authorities are: the President of the Republic of Poland, the Council of Ministers, the Prime Minister, ministers directing a branch of government administration, presidents of committees specified in statutes who are members of the Council of Ministers, and the National Council of Radio Broadcasting and Television. This article analyses the relationship between issuing and signing regulations. It is argued that, in the case of collegial authorities, a signature is declaratory in nature: it confirms the adoption of a regulation, whereas in the case of monocratic authorities, it is constitutive in nature, and the act of signing is equivalent to the issuance of the regulation. A key issue is the signing of regulations on behalf of the heads of single-person authorities. This is of particular significance – due to the widespread nature of the practice – in the case of ministers, one whose behalf regulations are signed by secretaries and undersecretaries of state. This article presents arguments supporting the claim that this practice, despite its approval by the Constitutional Tribunal, is incompatible with the constitutional concept of the sources of law and should be abandoned.

Rozporządzenia jako źródła powszechnie obowiązującego prawa i akty wykonawcze wobec ustaw zostały już dość dobrze opisane w piśmiennictwie. Stosunkowo mało miejsca poświęcono jednak organom upoważnionym do ich wydawania, tj. Prezydentowi Rzeczypospolitej Polskiej, Radzie Ministrów, Prezesowi Rady Ministrów, ministrom kierującym działami administracji rządowej, przewodniczącym określonych w ustawach komitetów, którzy są członkami Rady Ministrów, oraz Krajowej Radzie Radiofonii i Telewizji (KRRiT). Prima facie przedmiotowa tematyka nie jawi się jako kontrowersyjna. Tymczasem niektóre aspekty podmiotowe, zwłaszcza wydawanie rozporządzeń w zastępstwie Prezydenta RP oraz ich podpisywanie przez sekretarzy i podsekretarzy stanu, budzą poważne zastrzeżenia. Są one na tyle istotne, że mogą mieć znaczenie dla oceny ważności tych aktów. Dlatego też w niniejszym artykule poddano analizie teoretyczne oraz praktyczne problemy wyłaniające się na tym tle. W kolejnych częściach artykułu skupiono się zatem na konstytucyjnych wymogach związanych z wydawaniem rozporządzeń, zastępowaniu w tym zakresie Prezydenta RP, skutkach zmiany organu upoważnionego do wydania aktu, a także na prawnych aspektach podpisywania rozporządzeń.
