The Court of Justice, in its Opinion 2/13 concerning the draft agreement on the accession of the European Union to the European Convention for the Protection of Human Rights and Fundamental Freedoms, concluded that the agreement envisaged is not compatible with EU law. As the main argument for such conclusion – with respect to the area of CFSP, which is discussed in this article – the Court of Justice pointed out that the agreement envisaged failed to have regard to the specific characteristics of EU law with regard to the judicial review of acts, actions or omissions on the part of the EU in CFSP matters in that it entrusted the judicial review of some of those acts, actions or omissions exclusively to a non-EU body. The article contains an analysis and evaluation of this standpoint of the Court of Justice, in particular in view of the conclusions drawn out from its jud-gments and opinions, in which it determined the requirements to be met by an international agreement in order to preserve the autonomy of the EU legal order.
