In the Pursuit of Justice : (Ab)Use of the European Arrest Warrant in the Polish Criminal Justice System

Poland is the leading country in pursuing its own citizens under the European Arrest Warrant (EAW), with the number of EAWs issued between 2005 and 2013 representing one third of the warrants issued by all EU countries (although some serious inconsistencies between Polish and Eurostat statistical data can be observed). The data show that Poland overuses this instrument by issuing EAWs in minor cases, sometimes even for petty crimes. However, even though this phenomenon is so widespread, it has attracted very little academic interest thus far. This paper fills that gap. The authors scrutinise the topic against its legal, theoretical and statistical backdrop. Based on their findings, a theoretical perspective is drawn up to consider what the term ‘justice’ actually means and which activities of the criminal justice system could be called ‘just’ and which go beyond this term. The main question to answer is: Should every crime be pursued (even a petty one) and every person face punishment – even after years have passed and a successful and law-abiding life has been building in another country? Or should some restrictions be introduced to the law to prevent the abuse of justice?

Niniejszy artykuł przedstawia problematykę przestępczości cudzoziemców w Polsce oraz zjawisko ich wiktymizacji w oparciu o statystyki policyjne. Podjęto w opracowaniu próbę omówienia etiologii pokrzywdzenia cudzoziemców przestępstwem oraz ukazano trudności i osiągnięcia związane z badaniem tego zjawiska. Przedstawiono także możliwe przyczyny zaangażowania imigrantów w działalność przestępczą. W kluczowej części opracowania ukazano, w oparciu o statystyki policyjne, dane liczbowe dotyczące skali przestępczości imigrantów w Polsce, struktury tego zjawiska oraz samych sprawców. Następnie omówione zostały dane na temat skali pokrzywdzenia imigrantów przestępstwem w Polsce oraz dotyczące osób pokrzywdzonych.

This article presents the issue of crimes committed by immigrants in Poland and the issue of their victimization based on police statistics. Authors describe the etiology of victimization of immigrants and show the problems and the achievements related to the study of this phenomenon. The article presents the possible causes for committing crimes by immigrants. In the main part, based on police statistics, authors present the size and structure of crimes committed by immigrants and analyze who are the offenders. They also show the size of crime victimization on the immigrants in Poland and data about victims.

Determinants of the Judicial Response to Juvenile Delinquency

The article identities the determinants of the judicial response to juvenile delinquency which is a subject of interest to practitioners and theoreticians of law, criminology and other academic disciplines. Special attention is given to two of the harshest custodial measures for juveniles in the Polish legal system, viz. placement in a youth educational centre or in a correctional centre. The analysis was conducted on the basis of material collected during the course of research made at the Institute of Justice in 2015-2016 on a sample of 370 court case tiles on 457 juveniles. It attempts to determine which factors influence judicial decisions on juveniles, and whether judicial practice is consistent with the procedural rules adopted for dealing with this category of offender. The article is divided into three parts: the distinctive features of the Polish framework for dealing with juveniles, a review of the studies conducted to date and a description of the results of the authors' own studies.
