The Crisis of Multilateralism Through the Prism of the Experience of the International Criminal Court

This chapter confronts the concept of multilateralism with the international criminal justice system in which the International Criminal Court (ICC) plays a pivotal role. In this context, it looks at the defining elements of multilateralism and investigates how it is mirrored in the structure and practice of the ICC, specifically how it is institutionalized and whether the rules and obligations are common and equal to all states and equally applied. On that basis, it shows that the ICC – as the product of multilateral cooperation – plays a twofold role in international relations. On the one hand, it is an international organization enabling discussion via the Assembly of States Parties on international criminal justice – thus it strengthens multilateral cooperation and supports the idea of fighting against impunity. On the other hand, as a result of its specific role as a criminal court struggling against impunity for international crimes, the ICC usually acts as a suppliant requesting state cooperation and broader national engagement, thus pointing out the weaknesses of multilateral collaboration. The chapter finishes with a brief analysis of the potential consequences of COVID-19 for the ICC, as the pandemic has also exposed the shortcomings of multilateral relations in the area of international criminal justice.

Polish Practice on Promulgation of International Agreements between Poland and the USSR : 1944–1960

This article raises the issue of the proper publication of international treaties and their presence in the Polish legal system. The authors analyze this issue based on research conducted on Polish-Russian treaties from 1944–1960. Their research has shown that, during this period, only 11% of treaties were properly published. The research – conducted on a very limited subject: only bilateral agreements between Poland and the USSR – leads to the pessimistic conclusion that in Poland it is customary practice to refrain from publishing an international agreement in the Journal of Laws and that citizens do not have at their disposal a single official or unofficial source to reconstruct Poland’s current obligations, which may indeed directly concern them. Also this finding raises important questions about the accessibility and enforceability of international treaties in the Polish legal system. At the international level, the consequences of failing to publish an act and to ensure official promulgation can be much more serious. In the absence of information about published agreements, it is not possible to sufficiently and completely determine the obligations between states nor to reconstruct the relations binding them. It is also impossible to clearly determine which international agreements are still in force between countries, which are invalid and which have expired.

The Polish Yearbook of International Law (PYIL) is one of the few Polish legal journals published in English. Founded in the dark times of communism as an attempt to build intellectual bridges with the West, it went through the difficult period of wild capitalism in the 1990s, characterised by a permanent lack of public funding, only to more recently face the challenges posed by the technological revolution in the area of scientific publishing and the rapidly accelerating process of research quantification. This chapter tells the story of the PYIL. It starts by examining the origins of the Yearbook (i.e. when was it founded; by whom; and in what historical context). This discussion is followed by the presentation of its development over the last five decades (i.e. its evolution, nature of and reasons behind the relevant changes). Next the chapter turns its attention to the function and impact of the PYIL in the academic, political, and judicial spheres. The last section looks into the future of the Yearbook and articulates the general publication visions of the current Editorial Board for the upcoming decade.

European Neighbourhood Policy and EU Enlargement

The chapter focuses on the European Neighbourhood Policy, placing it not only within the framework of the policies of the European Union (EU), but also within the framework of public international law, on the one hand, pointing to the differences in the approach of organizations, and on the other hand, focusing on their common values and interests. Additionally, policies related to the enlargement of the Union and the withdrawal of its permanent members from it are discussed. The analysis indicates the achievements and challenges of neighbourhood policy of the EU taking into account the values promoted by the EU underlying the respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights and sharing common universal values and friendly relations within the borders of the concrete States.
