Defining memory laws and identifying the field of mnemonic constitutionalism has made it possible to create a separate research area within legal sciences. Simultaneously, law remains a tool for states to conduct memory politics, and because of its prominence and symbolic significance, authorities – regardless of the agenda followed or ideological preferences – use it to influence collective memory of the past. However, the belief in the infallible efficiency of these laws is illusory. The truth about the perpetration of the Katyń massacre survived in the Polish society during the period of Stalinist terror and communist falsification, while bans on Holocaust denial in Europe have not enabled eradication of this phenomenon from public discourse. However, the wider the areas of memory are infiltrated by law and the more political populism enters this field, using law to decree a single permissible vision of the past, the more problematic it becomes to consider memory laws as legal instruments that meet the standards of human rights protection.
